What is it?

The 2018 Farm Bill, also known as the Agricultural Improvement Act (Public Law No: 115-334), federally legalized hemp in the United States. The law defines hemp as Cannabis sativa L. and any part of that plant containing no more than 0.3% Delta-9 THC by dry weight.

Delta-9 THC limit:

Delta-9 THC is the primary psychoactive compound in cannabis. In raw hemp flower, the Delta-9 THC that is measured in testing is already in its active form, while most of the other cannabinoids (like THCA) remain non-psychoactive until heated. Because hemp contains no more than 0.3% Delta-9 THC by dry weight, it generally presents a much lower risk of intoxication compared to cannabis from dispensaries, which often contains 1–3% Delta-9 THC or more.

By removing hemp from the Controlled Substances Act, the 2018 Farm Bill made it possible to cultivate, process, and sell hemp-derived products — including flower, concentrates, and oils — as long as they remain within the federal Delta-9 THC limit of 0.3% by dry weight.

In its unheated, raw form, THCa remains federally legal under the Farm Bill if derived from hemp and contains less than 0.3% Delta-9 THC.
